These Terms & Conditions ("Terms") form a binding agreement between you and My Baseball Stats ("My Baseball Stats", "we", "us" or "our") governing your access to and use of the website at mybaseballstats.online and our associated application (together, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not access or use the Service.

If you are creating or managing an account on behalf of a child, you confirm that you are that child's parent or legal guardian and that you accept these Terms on their behalf — see Section 2.

1. About the Service

My Baseball Stats is a personal batting-statistics platform for baseball and softball players. It lets you create a player profile, create or join teams, schedule fixtures, and record batting statistics in Basic or Advanced mode. Optional features include Virtual Teams (following stats across clubs and leagues), Scoring Delegates (letting someone else record at-bats on your behalf), and Family Membership (managing multiple linked player profiles from one account).

My Baseball Stats is a personal record-keeping and visualisation tool. It is not an official scoring, statistics, or governance system for any league, club, or competition, and we make no representation that data recorded in the Service will be recognised by any third-party league or association.

2. Eligibility

• You must be at least 13 years old to independently create and manage your own account.
• If you are under 13, a parent or legal guardian must create and manage your account on your behalf, including entering or approving personal information and reviewing statistics recorded for you. We do not knowingly allow children under 13 to create or control their own account without parental involvement.
• By creating an account for or on behalf of a minor, you represent that you are their parent or legal guardian, or otherwise authorised to act for them, and you accept responsibility for their use of the Service and for the accuracy of information entered.
• You must provide accurate, current and complete information and keep it up to date.

3. Accounts, Scoring Delegates & Family Membership

• You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at customer.service@mybaseballstats.online if you suspect unauthorised use.
• A Scoring Delegate is someone you invite to record at-bats on your behalf. You choose who to grant delegate access to, and you can revoke it at any time from your account settings. We are not responsible for data a delegate enters, edits, or deletes while their access is active.
• Under a Family Membership, the primary account holder is responsible for the linked player profiles, including their accuracy and any billing associated with the plan.
• Accounts are personal to you. You may not sell, transfer, or share your login with anyone else, and each player should have only one personal profile.

4. Subscriptions, Free Trial & Billing

• Certain features require a paid Gold Membership, priced as shown on our Pricing page (currently $2.99 AUD per month, plus $1.99 AUD per month for each additional linked family member). Prices are shown inclusive or exclusive of applicable taxes as indicated at checkout.
• New accounts may start with a free trial of Gold Membership, the length of which is disclosed at sign-up. Unless you cancel before the trial ends, your membership automatically converts to a paid subscription and you will be billed using your chosen payment method.
• Subscriptions automatically renew each billing period until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and you keep access to paid features until then.
• Except where required by law, fees already paid are non-refundable, including for partial billing periods. This does not affect any non-excludable consumer guarantee or refund right you have under applicable law, including the Australian Consumer Law.
• We may change our prices or plans from time to time. We'll give you reasonable notice of a price increase before it applies to your next billing period; continuing to use the Service after a price change takes effect means you accept the new price.
• Payments are processed by third-party payment processors. We do not store your full card details. Your use of a payment processor is also subject to that processor's own terms and privacy policy.
• If a payment fails, we may suspend access to paid features until payment is successfully made.

5. Your Stats & Content

• You (or, for a minor, their parent/guardian) retain ownership of the statistics, profile information and other content you or your Scoring Delegate submit to the Service ("User Content").
• You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt and display your User Content solely as necessary to operate, maintain and improve the Service, and to create aggregated or de-identified statistics and insights that cannot reasonably be used to identify you.
• We will not use your identifiable User Content in public marketing (for example, as a testimonial) without your separate consent.
• We do not guarantee the accuracy, completeness, or reliability of statistics calculated from data that you, another user, or a Scoring Delegate enters. You are responsible for reviewing data recorded on your behalf.
• You may export or request deletion of your data at any time as described in our Privacy Policy.

6. Acceptable Use

You agree not to:

• use the Service for any unlawful purpose, or in a way that infringes anyone else's rights;
• impersonate any person or entity, or misrepresent your affiliation with a team, club or league;
• enter false statistics in bad faith, or tamper with data belonging to another player without authorisation;
• upload or transmit viruses, malware, or other harmful code;
• harass, bully, or collect personal information about other users without their consent;
• attempt to gain unauthorised access to the Service, other accounts, or our systems, or interfere with normal operation of the Service;
• scrape, reverse-engineer, or use automated means to access the Service except as permitted by us in writing.

We may investigate suspected violations and take appropriate action, including suspending or terminating accounts, without prior notice where reasonably necessary to protect the Service or other users.

7. Intellectual Property

The Service, including its software, design, text, graphics, logos and trademarks, is owned by My Baseball Stats or our licensors and is protected by intellectual property laws. Except for your User Content, nothing in these Terms transfers any ownership rights to you. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service without our prior written permission. Any feedback or suggestions you give us about the Service may be used by us without restriction or compensation to you.

8. Third-Party Services

The Service may link to, or rely on, third-party services such as payment processors, hosting providers, and analytics tools. We are not responsible for the content, policies, or practices of third-party services, and your use of them is at your own risk and subject to their own terms.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that statistics generated by the Service will be accurate or fit for any particular purpose, including selection, recruitment, or eligibility decisions made by any third party.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified, including under the Australian Consumer Law.

10. Limitation of Liability

To the maximum extent permitted by law, My Baseball Stats and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Service. To the extent permitted by law, our total liability to you for any claim arising from these Terms or the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose.

This section does not limit liability that cannot be excluded or limited under applicable law, including for death or personal injury caused by negligence, fraud, or breaches of non-excludable consumer guarantees.

11. Indemnity

You agree to indemnify and hold harmless My Baseball Stats and its officers, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third party's rights, except to the extent caused by our own breach or negligence.

12. Termination

You may stop using the Service and close your account at any time from your account settings. We may suspend or terminate your access if you breach these Terms, if required by law, or if we reasonably believe your actions may cause harm to the Service, other users, or us. On termination, your right to use the Service ends immediately; provisions of these Terms that by their nature should survive termination (including Sections 5, 7, 9, 10, 11 and 14) will survive.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service or for legal or operational reasons. We'll post the updated Terms on this page with a new "Last updated" date, and where changes are material we'll provide additional notice (such as an in-app notice or email) before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Victoria, Australia, without regard to conflict-of-law principles. If a dispute arises, we encourage you to contact us first at customer.service@mybaseballstats.online so we can try to resolve it informally. Subject to that, you and My Baseball Stats submit to the non-exclusive jurisdiction of the courts of Victoria, Australia. If you access the Service from outside Australia, you're responsible for complying with local laws where applicable.

15. General

• Severability — if any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
• No waiver — our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment — you may not assign these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Entire agreement — these Terms and our Privacy Policy make up the entire agreement between you and us regarding the Service.
• Force majeure — we are not liable for delays or failures caused by events beyond our reasonable control.
